Jury Finds In Favor Of Growers In Southern Idaho Herbicide Drift Case

by Tom Alexander on August 30, 2009 · 1 comment

OustA federal jury has found the Bureau of Land Management and E.I. DuPont de Nemours and Co. negligent in the use and application of an herbicide blamed for damaging thousands of acres of crops across a broad swath of southern Idaho in a herbicide drift case that has implications for farmers across the nation.
It is way past time that herbicide drift (and in the future, GMO pollen drift) was found to be the fault of the companies and people who apply them. Organic and even conventional growers can have their farms and livelihood ruined by the drift of herbicides and GMO pollen.
The incident that resulted in the lawsuit happened in 2001, and it took eight years for the creaky wheels of justice to prevail.

I can see how this would be litigious on a large scale, especially on the organic front. My hops were pollinated from pollen drift and they are definitely female.
